In the United States, the FDA (Food and Drug Administration) is the authority that decides if a new drug is fit for use with humans or not. Any new drug must undergo rigorous testing by a drug trials company to ensure its effectiveness and safety. All pharmaceuticals are under the close scrutiny of the FDA at all times. They analyze the whole process of the testing by the drug trials company as well as the packaging before they issue a license for it to be sold. Even after it is approved, they have the right to revoke the license at any time.
